These Terms of Use ("Terms") apply to the Hollywood Magic mobile application (the "Application"), an AI-powered image generation and creative design platform, provided as a Freemium service by 1080 Consulting ("Hollywood Magic," "we," "us," or "Service Provider").

By downloading, accessing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

1. Acceptance of Terms

By using Hollywood Magic, you agree to be bound by: • These Terms, and • Our Privacy Policy, and • Any additional rules or guidelines posted within the Application.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Application.

3. Use of the Service

Hollywood Magic allows users to upload images, enter creative prompts, and generate AI-powered movie posters and related imagery for entertainment and creative design purposes.

You agree to use the Application only for lawful, non-commercial purposes unless explicitly authorized in writing by the Service Provider.

You may not: • Upload, share, or generate content that violates the law or third-party rights. • Reverse-engineer, copy, modify, translate, or create derivative versions of the Application. • Attempt to extract source code or circumvent protections. • Interfere with the Application's operation, infrastructure, or security. • Create automated or bulk accounts to misuse free or promotional credits.

4. User Content & Ownership

You retain ownership of the images and materials you upload ("User Content").

By submitting User Content, you grant us a limited, non-exclusive, revocable license to: • Process and transform your content using AI models solely to generate results you request, and • Display generated results to you and store them securely for your use.

We will not sell, publish, or redistribute your content or likeness without your explicit consent.

5. Consent & Identity

To protect privacy and comply with ethical standards, you must: • Upload only images you own or have explicit permission to use. • Avoid uploading or generating content depicting real people without their consent. • Not impersonate others or create misleading likenesses or synthetic imagery of individuals without authorization.

Hollywood Magic maintains consent audit logs and may suspend or terminate accounts for violations.

6. AI-Generated Content

The Application uses Artificial Intelligence ("AI") technologies to provide certain features.

Generated results: • Are produced based on your prompts and inputs, • Are provided "as is" without warranties of accuracy, quality, or originality, and • May not be copyrightable and may have unclear ownership status depending on applicable law.

You are solely responsible for ensuring your use of generated content complies with all applicable laws and third-party rights.

AI services may include (but are not limited to): OpenAI, FAL.AI, Stability AI, Pixelverse, and Kling.

7. Prohibited Content

You may not upload, submit, or generate content that includes or promotes: • Nudity, sexually explicit material, or sexually suggestive poses • Violence, weapons, blood, or gore • Hate, discrimination, or harassment • Defamatory, misleading, or unlawful material • Copyrighted characters, brand logos, or trademarked assets you do not have rights to use • Realistic depictions of public figures or private individuals without consent

Violations may result in account suspension, deletion of content, and/or reporting to appropriate authorities where required or appropriate.

8. Intellectual Property

All rights in the Application—including its design, interface, prompts, templates, logos, trademarks, and underlying technology—are owned by the Service Provider and/or its licensors. Unauthorized copying, modification, translation, source-code extraction, or creation of derivative versions is strictly prohibited.

9. Purchases, Tokens, Credits, Refunds

Hollywood Magic may offer consumable digital items such as tokens/credit packs (e.g., "Starter Pack 10," "Pro Pack 50," "Ultra Pack 200") to generate AI images.

All sales are final once a generation has been initiated.

Refunds may be granted only for: • A duplicate/accidental purchase verified through your app store/payment provider, or • A technical error preventing token delivery or image generation.

Refund requests must be submitted within 14 days of purchase and are handled through the same platform that processed your payment (e.g., App Store, Google Play, or web checkout).

Unused tokens do not expire, but they may not be transferred, sold, or redeemed for cash.

We may refuse refunds for misuse, excessive claims, or violations of these Terms.

10. Privacy & Data

The Application stores and processes personal data you provide to deliver and improve the service. This may include User Content, prompts, generation metadata, and limited device information. We do not sell or share your data with third parties for advertising or profiling purposes. For details, review our Privacy Policy.

11. Third-Party Services

The Application may use third-party services that have their own terms and conditions, including (as applicable): • Google Analytics for Firebase • Expo • Sentry • RevenueCat

Your use of the Application may also be subject to those third-party terms.

12. Device Security, Jailbreaking/Rooting

It is your responsibility to maintain the security of your device and access to the Application. We strongly advise against jailbreaking or rooting your device, which may expose you to security risks and may cause the Application to malfunction.

13. Internet, Data Charges, and Availability

Some features require an internet connection. We are not responsible if the Application does not function at full capacity due to lack of Wi-Fi, depleted data allowances, or network issues.

If you use the Application outside Wi-Fi, your mobile carrier terms apply and you are responsible for any charges (including roaming). If you are not the bill payer for the device, you represent that you have permission from the bill payer.

You are also responsible for keeping your device charged; we are not liable if you cannot use the service due to a depleted battery.

14. Updates and Termination

We may update, change, or discontinue the Application at any time. Operating system requirements may change, and you may need to install updates to continue using the Application. We may terminate or suspend access to the Application at any time without notice if we believe you violated these Terms or to protect the service.

Upon termination: • The rights and licenses granted to you end, and • You must stop using the Application and, if necessary, delete it from your device.

15. Disclaimer of Warranties

Hollywood Magic is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We are not responsible for losses arising from reliance on information or functionality provided through the Application, including where third parties supply inputs or services.

16. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities. In no event will our total liability exceed the amount you paid (if any) for use of the service.

17. Changes to These Terms

We may update these Terms periodically to reflect legal, technical, or operational changes. Updates take effect upon posting. Please review these Terms regularly.

18. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes must be brought exclusively in the state or federal courts located in Los Angeles County, California.
